Starting Friday November 1, HRM Partners in Policing are taking over the withdrawal procedure from the Provincial Courts for two specific Summary Offence Tickets (ticket) issued within Halifax Regional Municipality (HRM).
Withdrawal can occur when a ticket has been issued for no insurance under Section 230(1) of the Motor Vehicle Act (MVA) or for unlicensed driver under Section 64 of the MVA. Withdrawal can be done if the driver can subsequently provide valid documentation to prove that he/she was not in violation at the time of the alleged offence.
Upon receiving a ticket under these sections, a driver has the option to attend HRM Police Headquarters to start the withdrawal process. There is a $25 fee to complete the process and the following documents are required:
Section 230(1) MVA – No Insurance
– Green (paper) or white (electronic) portion of the ticket
– Pink insurance card for the vehicle involved, valid for the time of the offence
– Light blue vehicle permit for the vehicle involved. The Vehicle Identification Number (VIN) on the vehicle permit must match the VIN on the insurance card
Section 64 MVA – Unlicensed driver
– Green (paper) or white (electronic) portion of the ticket
– A valid driver’s license for the time of the offence displaying the appropriate class of license for the vehicle operated. The effective to expiry date must cover the date the ticket was issued.
Withdrawal can only be done up to two weeks prior to the due date indicated on the ticket. Past this date, a driver will have to contact the Provincial Court before the due date to schedule a trial date. Drivers also have the choice of exercising one of the options provided on the reverse of the ticket for payment or trial any time before the due date.
The withdrawal procedure includes tickets issued by HRP and Halifax District RCMP for Halifax or Dartmouth Provincial Courts only. Withdrawal can only be processed at HRM Police Headquarters located at 1975 Gottingen Street in Halifax, 24 hours a day, seven days a week.
